Following is some information on fees and procedures associated with real estate sales in the Philippines. Sellers that are corporations or real estate dealers are subject to a 7.5% creditable withholding tax. Sales made by corporations or real estate dealers are also subject to a Value Added Tax (VAT) of ten percent (10%) of gross sale price. Sellers who are individuals pay a final capital gains tax of six percent (6%) of gross sale price. Individuals are exempt from the VAT tax on sale of their personal residences. Buyers usually pay Documentary Stamps (1.5% of gross sale price), Transfer Tax (0.5% of gross sale price) and Registration Fees (less than 0.1% of gross sale price). The Bureau of Internal Revenue (BIR) has established Zonal Valuations for properties throughout Metro Manila. If the gross sale price is less than Zonal Value, then Zonal Value is used in lieu of gross sale price for the purpose of computing the base upon which the above percentage taxes are applied. In all sales transactions handled through our office, we verify validity of titles and process documents personally, professionally, expeditiously and discretely. For foreign investors: Foreigners may buy undivided interests in real property up to 40%. That is, they may buy complete interest in individual condominiums and townhouses, provided 60% of the project owners are Filipino citizens; and, foreigners may buy homes and land via partnerships or corporations, provided the partnerships or corporations are 60% owned by Filipino citizens. Owners of real property are required to file annual tax returns with the Bureau of Internal Revenue. Generally, local bank financing of real estate is not available for non-Filipino citizens.
